Article 370 verdict Updates: The Supreme Court upheld the constitutional validity of the abrogation of Article 370 through a presidential order in 2019. A five-judge bench, headed by Chief Justice of India DY Chandrachud, held that the abrogation stands valid and that the provision under Article 370 was temporary, which was a result of war conditions at the time.
The verdict created an uproar in the Parliament where in the Rajya Sabha Home Minster Amit Shah & Congress Chief Mallikarjun Kharge engaged in a a war of words while discussing the Jammu & Kashmir Reorganisation (Amendment) Bill 2023.
In the verdict, the top court also noted that the President's order was not mala fide and that Article 370 provides for integration of Jammu and Kashmir and not for disintegration.
