South Africa brought a genocide case against Israel at the International Court of Justice (ICJ) in December 2023, alleging that Israel's actions in Gaza since October 7th violate the 1948 Genocide Convention. The conference defined genocide as acts with the intent to destroy a national, ethnic, racial, or religious group.
Today and Friday, the ICJ will hear South Africa's application for provisional measures, an emergency intervention meant to address urgent harm in the situation. Provisional measures do not determine if genocide is occurring; they allow the court to intervene while the case is ongoing.
The ICJ is an international judicial body of the United Nations dealing with disputes between states, and it is not a criminal court. South Africa has requested these measures due to the grave situation and immediate harm happening in Gaza.
